Determining fair use often depends on the circumstances. All materials in the slide collection at the University of Cincinnati are copyrighted. Reproduction of the collection, whether in digital or analog form, is not permitted unless permission is granted from the publisher or vendor of the item.
Items in the digital collection are also subject to copyright restrictions; however, Fair Use allows exceptions for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research.
In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include
(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
(2) the nature of the copyrighted work;
(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
(4) the effect of the use upon the potential market for or value of the copyrighted work.

ARTstor's statement: "If you print images or other content from the ARTstor Digital Library, you must use the designated print function provided in the ARTstor Digital Library. A label indicating that the content may only be used for noncommercial uses will automatically appear alongside the images on such print copies."
For use in dissertations and theses you must obtain permission from the underlying rights holder(s).
ARTstor's statement: "Content in Electronic Format Must be on Access Restricted Sites - No Posting to Unrestricted Websites on the World Wide Web.
