COPYRIGHT GUIDELINES FOR IMAGES

"Copyright law is still evolving when it comes to the fair use of photos and images on the web. The use of images in any format is a complex issue. Determining fair use often depends on the circumstances.

In general, when it comes to downloading images from the web, it has been determined by the courts that it is within fair use to download thumbnail images from a web site without asking permission or paying a licensing fee. Downloading full size images from a web site does not meet the fair use criteria. Unless the site clearly states that it is permissible to download images for free, you must request permission and possibly pay a licensing fee to do so.

All materials in the slide collection at the University of Cincinnati are copyrighted. Reproduction of the collection, whether in digital or analog form, is not permitted unless permission is granted from the publisher or vendor of the item.

Items in the digital collection are also subject to copyright restrictions; however, Fair Use allows exceptions for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research.

In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include

     (1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

     (2) the nature of the copyrighted work;

     (3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

     (4) the effect of the use upon the potential market for or value of the copyrighted work.

Printing ARTstor and AP Photo Archive images

Using ARTstor's images
ARTstor's Terms and Conditions:
ARTstor allows use of their images in term papers.

ARTstor's statement: "If you print images or other content from the ARTstor Digital Library, you must use the designated print function provided in the ARTstor Digital Library. A label indicating that the content may only be used for noncommercial uses will automatically appear alongside the images on such print copies."

For use in dissertations and theses you must obtain permission from the underlying rights holder(s).

ARTstor's statement: "Content in Electronic Format Must be on Access Restricted Sites - No Posting to Unrestricted Websites on the World Wide Web. If you make content from ARTstor available electronically (whether alone or incorporated into other materials), it must be in an access-restricted, password-protected site, so that only persons authorized under the Terms and Conditions of Use may access the site."

Using AP Photo Archive
AP Photo Archive permitted copyright uses by subscribers only:
"Printed copies of images for book reports, term papers, theses, class handouts and research."
