Copyright Questions and Answers

Q. May a DAAP professor reproduce an entire article from a scholarly journal owned by the University Libraries?

A. Most uses are considered fair use. Guidelines established by educators with the publishers allow photocopying without the publisher's prior permission if standards of brevity, spontaneity and cumulative effect are met. A list of what meets these standards is available in the DAAP Library. University educators can make copies for their students, but they cannot use the same article each quarter without permission of the copyright holder.


Q. Can a professor photocopy a variety of articles to substitute for the lack of a suitable text?

A. The permission of the copyright owners is required. Kinkos will not photocopy articles unless they have the permission of the copyright holder. Kinkos advises that faculty should contact them as soon as possible concerning copyright permission. Each publisher varies on response time. It is never too early to plan for each new quarter.


Q. May the DAAP Library accept a photocopy of an article from a professor for reserve use?

A. Yes, presumably the professor's copy is legally made.


Q. May the library make a single copy of an article from a journal in its collection to place on reserve at the request of a faculty member?

A. Yes, fair use applies in this case. However, the article cannot remain on reserve for more than one quarter without permission. Please see the first question for more information.


Q. May the DAAP Library make multiple copies of a journal article in its collection to place on reserve?

A. Yes, however, the amount of material should be reasonable in relation to the total amount of material assigned for one course and the number of students. In addition, the effect of the photocopying should not be detrimental to the publisher's ability to sell the work. The library has guidelines. Please consult with reserve staff for further information.


Q. Can an article on reserve for fall quarter be used for spring quarter?

A. No, permission of the copyright holder must be granted. Classroom on reserve use of photocopied material in multiple courses or successive years will require advance permission.
